Terms of Service

These Terms of Service ("Terms") govern your use of services provided by Random Monday Media ("we," "us," or "our"), a web design company based in Cedar Rapids, Iowa. By submitting our contact form or engaging our services, you agree to these Terms.

1. Services

Random Monday Media provides website design, development, and hosting services for local service businesses. We specialize in building professional, mobile-first websites for trades and home service companies. Specific deliverables, pricing, and timelines are agreed upon individually with each client.

2. Free Website Preview

We offer a complimentary website preview for your business prior to any payment or commitment. This preview is provided to demonstrate our work quality and what your site could look like. We retain ownership of preview sites until a service agreement and full payment are received. Preview sites may be removed at our discretion if no agreement is reached within a reasonable time.

3. Payment

Services are billed as agreed — typically a one-time build fee plus a recurring monthly hosting and maintenance fee. Payments are processed securely through Stripe. Failure to pay recurring fees may result in suspension of hosting services with at least 7 days prior written notice.

4. SMS Text Message Communications — Program Details

Program Name: Random Monday Media SMS Messaging Program

Program Description: We send SMS text messages to local business owners who have voluntarily opted in to receive communications from Random Monday Media, including free website preview links, project updates, and service-related follow-ups.

⚡ SMS opt-in is completely voluntary. You are never required to consent to SMS messages to receive our free website preview or any of our services. Consent to SMS is always separate from and independent of any service agreement or transaction.

4a. How Opt-In Works

You provide voluntary consent to receive SMS messages from Random Monday Media by:

Checking the optional SMS consent checkbox on our contact form at www.myrandommonday.com. This checkbox is not pre-checked, is clearly labeled "Optional," and does not affect form submission or service delivery if left unchecked.
Replying YES or START to an initial outreach text message about your free website preview.
Verbally consenting during a phone or in-person conversation with a Random Monday Media representative.

Leaving the checkbox unchecked does not prevent you from submitting the form or receiving your free preview. SMS consent is always a separate, independent, and voluntary action.

4b. Message Types

If you opt in, you may receive:

Your free website preview link
Project updates and milestone notifications
Service-related follow-up messages
Payment links and invoice notifications
Appointment and scheduling reminders

4c. Message Frequency

Message frequency varies. You may receive up to 5 messages per month. Frequency decreases after your project is complete and your website is live.

4d. Message & Data Rates

Standard message and data rates may apply based on your mobile carrier plan. Random Monday Media does not charge separately for SMS messages.

4e. How to Opt Out

You may opt out of SMS messages at any time by:

Replying STOP to any SMS from us. You will receive one final confirmation and no further messages will be sent.
Emailing randommondaymedia@gmail.com with "SMS Opt Out" in the subject line and your phone number.
Calling (319) 936-3670 and requesting removal.

Opting out of SMS does not affect any existing service agreement, your free website preview, or any other services you have engaged us for.

4f. How to Get Help

Reply HELP to any SMS from us to receive support contact information. You may also reach us at randommondaymedia@gmail.com or (319) 936-3670.

4g. No Third-Party Sharing

We will not sell, share, rent, or transfer your mobile phone number to any third party for marketing purposes. Your number is used exclusively for direct communications between you and Random Monday Media.

4h. Supported Carriers

Our SMS program is supported by all major U.S. carriers. Carrier availability may vary. We are not liable for delayed or undelivered messages due to carrier issues.

5. Client Responsibilities

Provide accurate business information for use on your website
Review and approve website content before launch in a timely manner
Ensure you hold rights to any logos, photos, or images you provide
Notify us promptly of changes to your contact information

6. Intellectual Property

Upon full payment, you own the content and design of your website. We retain the right to display your completed site in our portfolio unless you request otherwise in writing within 30 days of launch.

7. Hosting & Uptime

We make commercially reasonable efforts to maintain uptime for all hosted websites. We are not liable for downtime caused by third-party hosting providers or circumstances outside our control.

8. Cancellation

Either party may cancel the hosting agreement with 30 days written notice. Upon cancellation and settlement of any outstanding balance, we will provide your website files in a standard format. No prorated refunds are issued for partial months.

9. Limitation of Liability

Random Monday Media is not liable for indirect, incidental, or consequential damages arising from use of our services. Our total liability is limited to amounts paid in the 30 days preceding any claim.

10. Governing Law

These Terms are governed by the laws of the State of Iowa. Disputes shall be subject to the exclusive jurisdiction of courts in Linn County, Iowa.

11. Changes to These Terms

We may update these Terms at any time. Continued use of our services after changes constitutes acceptance. We will make reasonable efforts to notify you of material changes via email or SMS.
